Death by a thousand curb cuts.
At tomorrow¹s Cambridge City Council meeting, councilors will consider a
proposed rules change transferring special permit granting authority from
the Cambridge Planning Board, where it currently resides, to the City
Council. Special permits, a zoning tool allowing uses and activities
beyond what is allowed "by right" under certain conditions, require approval
by the local special permit granting authority.
In my view, moving the authority ("SPGA") from the Planning Board to the
City Council is a terrible idea and, if adopted, will create untold problems
for the Council, where only one member of the current nine can claim any
expertise in urban design, planning or architecture.
More importantly, the citizens of Cambridge will not see an improved process
or better outcomes. Instead, they will see a further contorting of our
public debate because now all development will become overtly political.
Furthermore, the relationship between councilors and developers will grow
toxically close, undermining the principle of healthy arms-length
deliberation by the decision-making body. What follows began as an list
serve exchange and expresses my views on the matter in greater detail.

I do not believe having the City Council doing specific project review is a
good idea. As an urban planner who served on that body for four years, it
was never my experience that the Council was prepared to do the detailed
work of project review. My opinion has not changed since. It's not what a
City Council is made for, and it's not what it should be doing with its
valuable time.
There are plenty of instances showing just what a tough time the Council has
in making timely decisions in contentious development debates.
Consider curb cuts. These petitions over access to the public way come to
the Council periodically after a thorough review by city staff. Sometimes
they are non-controversial, but often they cause a firestorm of opposition
requiring huge amounts of discussion and negotiation. The curb cut on Avon
Hill split the neighborhood and demanded months of work to sort through. A
curb cut, by anybody¹s reckoning, is microscopic compared to the complexity
of design arguments on a 20 story building where thousands of different
design criteria come into play.
The Foundry Building is another example. In 2009, the city was given this
structure a building of about 60,000 sq. feet as part of a mitigation
agreement with Alexandria Real Estate for its Binney Street developments. As
of this month, June 2014 five years later the City Council still has not
been able to decide what should happen with that building. This does not
auger success (or sane governance) if the Council's responsibilities expand
in a significant manner.
To me, the Foundry Building process is typical of what happens when
political bodies try to get their hands around a very specific decision.
Individual councilors focus on their individual concerns, and can grow
intransigent. This locks up the process and freezes any motion. To
unfreeze the situation, pols negotiate with each other until a sufficient
number of votes are reached. That is not urban design. Nor would it be
project review. It is horse-trading, plain and simple.
Furthermore, the political pressures will force us to design by committee.
Given the amount of trouble we already have reaching agreement about
buildings under our existing process, I cannot imagine how this is an
improvement. Blandness will prevail in our design choices. Everyone from
developers to community voices will opt for "safe" because it will be the
easiest. Offending the least number of people is not a mark of leadership.
Not in environmentalism. Not in urban design. It just seems like
architectural retrenchment to me and expresses fundamentally conservative
tastes rather than progressive and challenging ones. This is not a version
of project review I want to see.
Also, the scope of work involved in project review is large. I count nine
projects "Special Permit - Granted" in 2014, totaling altogether 1.9 million
square feet. I wonder on what basis will unelected aides and their
councilors be making decisions about what passes muster? What happens in the
case when only three community members show up to the meeting? Do they
become the group to decide? And what happens when nobody shows up to voice
an opinion? Is it just the whim of the councilor say one trained as a
peace activist, or in non-profit management, or in law to decide what that
building should look like? This is not an improvement over our current
system.
Now, consider the impact this will have on the relationship between city
councilors who will hold final say over projects and developers who stand to
reap huge benefits for projects that move forward. Developers will be
petitioning councilors constantly, seeking their blessing on minute aspects
of design and aesthetics. Over time, this will bind these two parties
together at the hip more closely. The logical conclusion of this
relationship is not a healthy picture at all. Added to this, it is simply
true that councilors have busy schedules and focus on their own issues
whether those are early childhood development or greenhouse gas emissions
reductions. Often this means they defer to committee chairs on subject
matters not their own. In practice, this is not a bad thing it is how
committees are supposed to work but it means that all of this design
decision-making authority will be run through one committee chairperson (or
possibly two, if there are co-chairs). That is simply worse than the system
we have now, whatever its flaws.
The special permit granting authority also creates a new (and onerous)
timetable for the City Council, one which I believe it will have a hard time
meeting. Under Massachusetts General Laws, Chapter 40A Section 9, the SPGA
is required to hold its initial hearing within 65 days of an application
having been filed. The decision has to be handed down within 90 days of
that initial hearing, unless the timeline is extended by agreement of both
parties. This will be in addition to the timeline the Council must meet for
all zoning petitions, and if the Council fails to act in the 90 days, this
provision kicks in:
> Failure by the special permit granting authority to take final action within
> said ninety days or extended time, if applicable, shall be deemed to be a
> grant of the special permit. (MGL, Ch.40A, sec.9)
As well, it is worth noting that the appeals provisions in MGL Ch 40A
section 17 are broadly inclusive:
> Any person aggrieved by a decision of the board of appeals or any special
> permit granting authority whether or not previously a party to the
> proceeding ... may appeal to the land court department, the superior court
> department in which the land concerned is situated
Furthermore
> If the complaint is filed by someone other than the original applicant,
> appellant or petitioner, such original applicant, appellant, or petitioner and
> all members of the board of appeals or special permit granting authority shall
> be named as parties defendant with their addresses.
It is fair and reasonable to ask if the Council will effectively be able to
meet the mandated timelines without creating a situation of endless
extensions producing something very close to a work-stoppage on all
development. Furthermore, my reading of the appeals provision states that
anyone can file an appeal, and that all city councilors would be named as
defendants. This could quickly become an unworkable situation in a city
where all development proposals are highly politicized and contentious.
Planning boards were established exactly to create separation between
elected bodies and more technical decisions that need to be made about
buildings. Accountability is a good thing, of course we want the ability
to throw the SOBs out of office at the next election but it is axiom that
politicians often can't see further down the road anyway. Someone needs to
keep an eye on the long-range needs and demands of this community. In a
place where small numbers of active voters can skew any discussion
significantly and developers pursue their own agenda, this proposal won't
solve any of it. In fact, it will only make it a lot worse.

Greens and radishes are spectacular this spring. I boast about this having
seen Steve Parker's kale and spinach, Hutchins Farm's organic red-leaf
lettuce and Dick's Market Garden huge Romaine lettuce.
Parker already has beets and carrots. Kimball's has two kinds of radish and
juicy sweet hydroponic-grown tomatoes - a large size, a racquet-ball-sized
brand and cherries, all with enormous flavor. The "hydro house," which
provides plants with nutrients and water without a traditional soil bed,
will go on producing tomatoes through fall. The award-winning Kimball's also
raises a vast array of tomatoes on about 12 acres of fields with "a couple
more to plant" for the late season, said Dan Wadleigh.
With the warm weather, why not enjoy Tipping Cow's cold creamy ice cream
with unusual creative flavors such as sweet corn, cinnamon-oatmeal and
strawberry basil? I particularly like the ginger berry.
The earliest settlers cleared land to create planting fields. Well, so do
our farmers today. When Steve Parker expands and leases fields in and around
Lunenburg, he often has to clear out trees, stumps, rocks and sod - a major
task. "But once you get it into shape, next year it will be easier," he
said.
Many folks have been asking about Farmer Al who is bouncing back after a
hurtful fall. He said he plans to make his 2014 inaugural appearance this

The food that goats eat greatly influences the taste of the milk that
becomes goat cheese. At Cedar Hollow Farm in Vermont Chris and Craig Decato
said their goats eat hay and feed to give the milk a rich taste. They won't
let them feed on grass which would result in an unappealing milk taste. Goat
milk is whiter than cow's milk and that's why goat cheese looks so white.
"Commercial goat cheese often have coloring added to them, derived from
annatto, to make them appear more creamy or yellow in color," says the
website Everything Goat Milk. What about the stereotype of goats chomping on
tin cans, I asked. "Those are Billy goats," she said, not goat cheese goats.

As managers of the market, we have a tent at the Trinity Church end of the
St. James row of tents where we are available to field questions (along with
suggestions and complaints), attend to market logistics, and deal with
anything and everything that can happen in a great, crowded urban
green-space.

Some days are more challenging than others:
We are not big fans of rain during the market, but rain before a market can
be a problem as well. Last week we had a good soaking rain before our
Tuesday market that played havoc with the Square's electrical service (it
is all underground). Many of our vendors rely on the electrical service to
maintain conditions for their perishable products. Without full electrical
service everyone scrambled and moved to Plan B (there may have been a bit of
venting to the management along the way). Being a vendor at Copley is like
being part of a quirky family. Last week everyone involved pulled together,
shared equipment and worked together to make sure perishable products were
maintained under proper conditions. Thanks to everyone who made this happen.
At market this week:
Look for plant starts to disappear from the market soon. Best to pick up
what you need when you see it and perhaps even pick up some spares for
mid-season replacements. Vendors have a good supply of kale, leafy greens,
peppers, tomatoes, cucumbers, brassicas, herbs and flowering plants in four
and six packs as well as individual pots. Come look and be inspired to keep
planting.
Leafy greens are still dominating the market, but summer crops are
demanding more and more space each week. The hothouse tomatoes continue
along with early cucumbers (pickling, slicers and long seedless), summer
squash and scallions. Check out the vendors own websites or blogs where they
provide late breaking updates of what they will be bringing to market.

It seems that the weather has finally turned, so we really should be
expecting to see the last of the asparagus and rhubarb. I know I keep saying
this and it keeps arriving at market, but consider yourself warned.
Garlic scapes are in the market for a short time as well. If you've never
tried them you really need to - they are a real taste of the season. The
farmers can suggest ways to use them if you don't already have a recipe in
mind.
Don't miss the strawberries. Local strawberries have arrived and are living
up to their promise (unlike their picked unripe and shipped from far away
cousins). Sweet and flavorful use them now or preserve them for later.

We're entering the first of several threshold moments of the Farmers Market
season when farmers are able finally to harvest the results of their first
planting.
Kimball Fruit Farm has tasty miniature broccoli crowns, non-sprayed bok,
green garlic and much more. Enterprise Farm has sensational organic kale,
lettuce and tomato plants whose flowers portend their productivity.

Elizabeth and Leah employ a hand press and push down 4 times on each lime,
orange and lemon (good for the biceps). Then they add ice, mint and water
and let me say: It's refreshing!
Blue Heron Farm has delicious early organic beets and English shelling peas.
At the start of the market last week at noon, farmer Ellery had an adorable
cache of asparagus, just enough for 1 or 2 people. At many farms, asparagus
is already past though you may find some if you're lucky. My point here is:
customers who arrive early to the market may discover pleasant surprises
or vegetables that will sell out fast because they're so good or because
there was such a small amount. By the way, be sure to rinse asparagus well.

I hope you are enjoying this wonderful day. I'm writing to ask for your help
in securing space for universal pre-k in Cambridge.
As you may know, the City Council has decided to maintain the entire 53,000
square feet of the Foundry Building in East Cambridge for community space.
Currently the conversation is focusing on what type of programing will go
into this building.
At present, there is a significant push for STEAM (Science, Technology,
Engineering, Arts and Math) related for profit and non-profit companies to
occupy the entire building with the goal of having them provide internships
and job training for Cambridge teens. The message, specifically, has been
that kids in Area 4 grow up in the shadows of Kendall Sq. but can't access
jobs there. For the record, I agree with this a great deal and always
supported STEAM programming as a member of the School Committee.
My concern, however, is that we have made a commitment to universal pre-k in
Cambridge. There is currently a task force looking at how to make this a
reality. From what we know, money and space are going to be two significant
obstacles to bringing universal pre-k to our community. We also know that
many of the teens living in Area 4 struggle in our schools and that
providing them with a strong early childhood education is key to their
academic success and their ability to access the types of internships and
job training STEAM supporters want.
On the Council I have been advocating to maintain a portion of the Foundry
building for early childhood programming. I am suggesting 6,000 of the
53,000 square feet. That would allow for 6 early education classrooms to be
located in East Cambridge. So far, those on the Council supporting STEAM
have been unwilling to consider this in part because they have not heard
enough people advocate for early childhood education.
I am reaching out to you for help. If you support maintaining a small
portion of the Foundry for early childhood education then I need you to
speak up. Please email the Council at:CityCouncil@cambridgema.gov and the
City Manager at: CityManager(a)cambridgema.gov. You don't need to send a long
email, you can just say that you support maintaining a portion of the
Foundry building for early childhood education. Also, there will the a
meeting on Tuesday, June 24 from 6-8 at the Multi Cultural Arts Center in
East Cambridge to talk about this issue. There will be many people there to
advocate to use the entire building for STEAM. If early childhood supporters
don't speak up we will lose this opportunity. Please consider attending the
meeting.

Suspect Sought in Two Separate Indecent Assaults on Women
The Cambridge Police Department is seeking the cooperation of its residents
in identifying a suspect who potentially matches the description provided in
two indecent assaults that took place within the last week. At approximately
11:34 p.m. on Tuesday, June 17, the Cambridge Police responded to a report
of a female who was indecently assaulted by a male at the intersection of
Cambridge Street and Ellsworth Avenue. The suspect, described as a dark
skinned male approximately 18-25 years old wearing a bright red t-shirt with
dark shorts, was riding a bicycle and had a black backpack. He approached
the female and indecently grabbed her from behind. He fled and the victim
then contacted the police. Police units conducted a thorough search of the
area, but the suspect has not been located at this time. The bike was taken
into custody for evidence and a sketch of the suspect (see left) has been
released.
Cambridge Police believe the Cambridge Street/Ellsworth Avenue indecent
assault is possibly related to a similar incident that reportedly occurred
at approximately 11 p.m. on June 14 at Harvard Street. A female was walking
down Harvard Street near the intersection of Inman Street when two males on
bicycles approached her and one indecently grabbed her from behind. The
suspect was described as a male, approximately 18-25 years old with dark
curly hair, a light colored t-shirt and dark shorts. Both males fled down
Harvard Street toward Harvard Square. Police units thoroughly searched the
area, but the suspects were not located.
The investigation into these incidents is ongoing. As always, we urge
residents, particularly women, who may be walking alone at night, to remain
vigilant and aware of their surroundings. For your safety, you should try
to remain on well-lit routes and avoid wearing headphones or ear buds. Keep
your cell phone readily available, but avoid distracting phone calls. If
you suspect you are being followed, head for a store or building that you
know to be open. Trust your instincts. If you feel uncomfortable about
someone near you, head for a populated area and call 911 immediately.

CAMBRIDGE, Mass., June 12, 2014 The Cambridge Police Department will host
its first LIVE question and answer forum on Facebook and Twitter Monday,
June 16 at 7 p.m. The topic of the social media Q&A will focus on the
department¹s implementation and impending use of ShotSpotter. ShotSpotter is
a high-tech system that is used to alert police when and where gunfire
occurs. The system provides responding officers with critical information
such as number of shots fired, shooter position, direction of travel, and
the exact time of gunfire.
For one-hour, Cambridge residents and any interested members of the general
public can ask questions about the gunshot detection system and receive
answers in real-time from Deputy Superintendent Stephen A. Ahern, commander
of the Cambridge Police Department¹s Tactical Operations Unit, and Jeremy
Warnick, Director of Communications at the Cambridge Police. The goal is to
provide the public with pertinent information about the technology and
address any questions or concerns they may have about the use of this new
investigative tool.
